1. Your agreement with Portofolio
These Terms of Service govern your use of Portofolio, a photography software service operated by Deminschii Arcadie from the Republic of Moldova (“Portofolio”, “we”, “us”). “You” means the person or organisation using the service. You can contact us at deminschiiarcadie@gmail.com.
By creating an account or using the service, you agree to these terms. You must be at least 18, or the age of legal majority where you live if higher, and able to enter a binding agreement. If you act for a studio or other organisation, you must have authority to bind it. Gallery visitors must respect the access and download permissions set by the photographer and the acceptable use rules below.
The Subscription Terms and Refund Policy form part of this agreement. The Privacy Policy explains personal data handling. A specific order agreed with us controls its price and billing interval; it cannot reduce mandatory consumer rights.
2. What the service provides
Portofolio provides online photo storage, gallery organisation and presentation, client photo sharing and delivery, permitted client downloads and selections, portfolio website creation, and related photography business tools. Storage uses self-hosted server infrastructure. An online storage service is not an independent archival or backup guarantee.
Your available tools and storage allowance depend on your plan and the options shown in your workspace. Only functionality currently offered in the application is included. A demonstration, roadmap, or external integration does not promise a feature that is unavailable in your account. You are responsible for a compatible browser and internet connection.
3. Your account and security
Provide accurate account and contact information and keep it current. Keep your password and access links secure, use a password you do not use elsewhere, and manage access for people working for your business. You are responsible for activities you authorise through your account, but this does not make you responsible for failures caused by us.
Tell us promptly if you suspect unauthorised access. You can manage account information and available session controls in Settings. Do not access another customer’s account, bypass security controls, impersonate anyone, or interfere with the service.
4. Free plans, paid plans, and trials
Free includes 100 GB without a paid subscription. Starter, Pro, and Studio have the storage limits and confirmed EUR prices on the Pricing page and in the Subscription Terms. Monthly and yearly are separate billing intervals; the yearly figure is the total for a year, not a monthly charge.
Eligible accounts may activate one 14-day trial of a paid plan. No payment details are required for that trial. It does not charge you or automatically become a paid subscription. At trial expiry, your account returns to Free unless paid access has been separately activated. Canceling a trial or changing plans does not reset trial eligibility.
The application currently accepts paid-plan requests for administrator activation. Submitting a request does not charge you or grant paid access. There is no online payment checkout or automatic recurring billing in the application. Before you agree to a paid order, we must confirm the plan, billing interval, total payable, any applicable taxes or charges, and access period. We will not treat a trial or plan request as payment authorisation.
5. Billing, renewal, and cancellation
Current subscriptions do not renew automatically. A further paid period requires a separate arrangement and your agreement to its charges. Changing a plan or billing interval through a request does not immediately replace existing access or create a new charge.
To cancel, open Settings → Plans & billing and use Cancel subscription when available, or email support if you cannot access the control. Paid access continues through a recorded future subscription end date. If no future end date is recorded, cancellation returns the account to Free immediately; contact us first if your paid access period is unclear. Switch to Free is an immediate downgrade, including during a trial. Check your displayed access dates before choosing it.
Cancellation and a refund request are separate actions. Cancellation alone does not delete your account or uploaded files. The Refund Policy explains refunds, including legal withdrawal rights and material service failures.
6. Storage allowances and restrictions
Storage limits apply to stored content counted by the service, including gallery originals, photographs in trash, website media and other stored account media. The storage meter uses binary units: the displayed GB corresponds to 1,024³ bytes, and the displayed TB to 1,024 GB. Previews and other website assets may also contribute to usage.
If a trial or paid period ends, or you downgrade, the applicable quota becomes the new plan’s quota. Files are not automatically deleted solely because a subscription expires or you exceed that quota. New uploads are paused while usage exceeds the allowance; remove content or arrange an appropriate plan to resume uploads. Existing sharing remains subject to gallery visibility, expiration, deletion, and access settings.
This does not promise indefinite storage for inactive, closed, suspended, or terminated accounts. Before a planned account closure or a material change affecting access to lawful content, we will give reasonable notice and an opportunity to download it where practicable. Urgent security issues, legal requirements, or unlawful content may require earlier restrictions.
7. Acceptable use and image rights
Use Portofolio for lawful photography storage, presentation, and client delivery. You must have the copyright, permissions, lawful basis, and image or publicity rights needed to upload and share your content. Give clients and people shown in photographs any legally required privacy information and obtain consent where required, including appropriate parental or guardian permission for children’s photographs.
Do not upload or distribute illegal material, child sexual abuse material, non-consensual intimate imagery, exploitative or pornographic content, material infringing another person’s rights, malware, or content used for fraud, harassment, or unlawful discrimination. Do not use the service as an anonymous public file exchange, resell account access without agreement, evade quotas or access restrictions, or overload or attack systems.
We may restrict content or access where reasonably necessary to investigate a credible report, protect people or systems, or meet legal obligations. Where lawful and practicable, we will explain the restriction and provide a way to challenge a mistake by contacting support.
8. Your content remains yours
You and your licensors retain ownership of uploaded photographs, text, logos, and other content. Uploading does not transfer copyright to Portofolio. You grant us a limited, non-exclusive permission to receive, store, copy, process, resize, display, transmit, and deliver that content only as needed to operate the service according to your settings and instructions, provide support, protect the service, and comply with law.
This permission includes generating previews and download archives, and allowing necessary service providers to perform those tasks on our behalf under appropriate restrictions. It does not permit us to sell your photographs, use them in advertising, or train general-purpose AI models on them. Separate promotional use requires your permission.
The permission ends when the content is deleted from our systems, except for limited retention required by law, a dispute, or technically necessary deletion processes as described in the Privacy Policy. Copies already downloaded by your clients or independently retained by third parties are outside our control.
10. Portofolio intellectual property and reports
Portofolio and its licensors retain rights in the software, design, branding, and service materials, excluding your content and third-party materials. Your plan gives you permission to use the service for its intended purpose during your access period. Do not copy or redistribute our software or branding, or remove rights notices, except where the law permits.
Report suspected infringement to support with your contact details, the specific content URL, a description of the work or right concerned, and the basis for your complaint. We may request enough information to assess the report fairly and may inform the uploader where appropriate and lawful.
11. Availability and maintenance
We take reasonable care in operating the service, but do not guarantee uninterrupted availability, an agreed uptime percentage, or error-free operation. Maintenance, software updates, connectivity or power problems, third-party failures, and security incidents can interrupt access, uploads, or delivery. We will make reasonable efforts to address service problems and communicate significant disruptions where practicable.
Optional external services have their own availability and terms. Their inclusion does not expand our promises about features, storage durability, or delivery times. Nothing in this section removes a legal obligation to supply a conforming digital service or your remedies if we fail to do so.
12. Storage risks, backups, and data loss
We take reasonable measures to protect uploaded content. Nevertheless, no digital storage system can guarantee absolute protection against technical failure, accidental deletion, corruption, outages, unauthorised access, or permanent data loss. Portofolio does not guarantee permanent preservation of every uploaded file. The service does not include a guaranteed independent backup or restoration service.
Keep independent backups of important original photographs in a separate location and check that you can restore them. Do not use Portofolio as the only copy of irreplaceable work. Gallery expiration, deleting content, and account closure can also affect access; download anything you need before requesting permanent deletion.
If an incident occurs, we will make reasonable efforts to investigate it and restore recoverable data where technically possible. Recovery cannot always be completed. This explanation of storage risk does not excuse a failure to use reasonable care or exclude liability that the law does not allow us to exclude.
13. Refunds and consumer remedies
Our Refund Policy covers ordinary subscription refunds, duplicate or incorrect charges, verified technical failures, and permanent photo loss caused by a service-side failure. Affected paying customers may request a refund of fees paid for the affected billing period. A fair proportional refund may be appropriate where only part of that period or service was affected.
We review requests fairly and individually and will not unreasonably deny a refund where we are responsible for a material service failure. Refunds use the original payment method where supported. A subscription refund covers subscription fees; it does not place a value on lost photographs or automatically settle every legal claim. Statutory withdrawal, price reduction, termination, compensation, and other mandatory rights remain available where applicable.
14. A reasonable allocation of liability
To the extent permitted by applicable law, we are not liable for indirect or consequential losses, such as lost business opportunities, lost profits, or reputational losses arising from use of the service. For customers acting in a business capacity, our total liability arising from the service is limited to the greater of €100 or the subscription fees you paid us in the 12 months before the event giving rise to the claim, subject to the exceptions below.
These exclusions and the business liability cap do not apply to gross negligence, intentional misconduct, fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited. They do not restrict mandatory data protection rights, statutory consumer remedies, or refunds due under our Refund Policy. For consumers, any limitation applies only to the extent it is fair and permitted by the law protecting them.
You are not required by these terms to give up a claim merely because you receive a subscription refund. Any separate settlement must be expressly agreed and lawful.
15. Suspension, closure, and termination
You can stop using the service, cancel a plan in Billing, or request account deletion by emailing support from your account address. Account deletion is handled through support and is separate from cancellation. Verify that you have downloaded your content before requesting deletion.
We may suspend or terminate access for a material breach, unlawful use, a serious security risk, non-payment of an agreed charge, or a legal requirement. Where reasonable, we will give notice, explain the issue, and allow you to correct it. Immediate action may be necessary to protect people, content, or systems. Contact support if you believe a decision is mistaken.
If we discontinue the service or terminate paid access for reasons other than your material breach, we will provide reasonable notice and an export opportunity where practicable, and refund the unused prepaid period. Termination does not remove payment obligations already incurred or mandatory remedies. Content retention and deletion follow the Privacy Policy and applicable law.
16. Changes to the service and terms
We may improve or change the service and update these terms. We will publish an updated date and give reasonable advance notice of material changes affecting existing accounts, using your account email or an in-service notice where appropriate. Urgent legal or security changes may take effect sooner with an explanation where practicable.
We will not retroactively increase an agreed paid-period price or use an update to remove rights that have already arisen. If a material change adversely affects a prepaid service and you choose to end it, contact us about an appropriate unused-period refund, without limiting any additional statutory remedy. A new recurring billing arrangement would require separate clear disclosure and authorisation.
17. Applicable law and resolving problems
These terms are governed by the law of the Republic of Moldova. If you are a consumer, this choice does not deprive you of mandatory protections of the law of your habitual residence that apply to your purchase. Nothing requires a consumer to use a foreign court where they have a mandatory right to bring proceedings locally.
Please first contact support with a clear description of the issue so we can try to resolve it. Doing so is not a condition for exercising a statutory right or meeting a legal filing deadline. Unresolved disputes may be brought before a court with jurisdiction under applicable law; business customers agree to the competent courts in Moldova unless mandatory law requires otherwise. These terms do not impose compulsory arbitration.
If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful. A delay in enforcing a provision is not a waiver. For service questions, rights requests, copyright reports, or correspondence details, email deminschiiarcadie@gmail.com.
